judging purely from the picture, my personal opinion is that it was an accident...meaning i don't think anything dirty is going on between them at least in that snapshot. also, i hope you don't mind Mai if i disagree with you on them thinking they were still under water. i think the difference between being in and out of water is very noticable...from personal experience and what i can remember about being at the beach, you would be able to tell.
and their expressions also...Ken looks like his focus is one something somewhere else...whereas Janie's looks like "ahhh!!!" or "eekkks!!!"...or "ewww!!!" or any of those variations, lol...a surprised reaction to being touched like that.

i'll admit i'm inclined to think the good in people, but i don't particularly like (or dislike) either Ken or Janie, so this is also my honest opinion about the pic.

in a nutshell...to me it looks like the pic was taken at a bad moment that was unintended.
